In order to probate a last will and testament in Louisiana, you must first open a succession in court. A petition to probate the last will and testament is filed along with the last will and testament and presented to the court for probate.  In most instances, no hearing is necessary with the court to have the last will and testament probated.

Special Rules for Handwritten Wills

If the last will and testament is a handwritten last will and testament, additional evidence will be necessary to prove the handwriting on the last will and testament is that of the decedent.  This is usually handled by providing affidavits to the court.

Contested Wills

If the last will and testament is contested or challenged, the court will likely require a hearing before the court and require witnesses and evidence to be submitted to prove or disprove the last will and testament.
